Terms of Service

These Terms of Service ("Terms") govern use of the Flow Realty platform ("Service") by real estate agencies, their agents ("Agencies"), and members of the public interacting with an Agency through the Service (e.g. booking a viewing). By using the Service, you agree to these Terms.

The Service

Flow Realty provides property listing management, lead capture and automation, viewing scheduling, and related communication tools (WhatsApp/SMS, email) for Agencies operating in South Africa.

Agency accounts

  • Agencies are responsible for the accuracy of property listings, pricing, and availability they publish.
  • Agencies are responsible for the conduct of their agents using the Service, and for responding to leads and viewings in good faith.
  • Account credentials must be kept confidential; the Agency is responsible for activity under its account.

Viewing bookings and fees

  • Some properties may require a viewing fee, set by the Agency, before viewing slots and details are shown.
  • Viewing fees are processed by PayFast; we do not store payment card details.
  • Refunds of viewing fees are at the Agency's discretion — contact Support to raise a request.
  • Booking a viewing does not guarantee the property's availability or accuracy of listing details, which remain the Agency's responsibility.

Acceptable use

You agree not to:

  • Use the Service to send unsolicited or misleading communications.
  • Attempt to access data belonging to another Agency or tenant.
  • Interfere with or disrupt the Service's operation, including attempting to bypass payment or access controls.
  • Upload content you don't have the right to publish (e.g. property images, listings).

Third-party services

The Service integrates with third parties including Twilio (WhatsApp/SMS), Google and Microsoft (email), PayFast (payments), Property24 and Private Property (listing syndication), and Google Maps. Your use of those integrations is also subject to the relevant third party's own terms.

Availability and changes

We aim to keep the Service available and reliable but do not guarantee uninterrupted access. We may modify, suspend, or discontinue features of the Service at any time, and may update these Terms — continued use after a change constitutes acceptance of the updated Terms.

Limitation of liability

The Service is provided "as is". To the extent permitted by law, Flow Realty is not liable for indirect, incidental, or consequential loss arising from use of the Service, including disputes between an Agency and a prospective buyer or tenant.

Termination

We may suspend or terminate access to the Service for breach of these Terms, non-payment, or misuse. Agencies may cancel their account at any time by contacting Support.

Governing law

These Terms are governed by the laws of South Africa.
